Free Maps Conditions of Use

 

In this document unless the contrary intention appears:

‘Maps’  means and includes TASMAP products downloaded by you via the TASMAP web page (www.tasmap.tas.gov.au).

By downloading the Maps you are granted a non-exclusive, non-transferable licence to use the Maps and indicate your acceptance of the following Conditions of Use (COU).

  1. All Maps downloaded are subject to Crown Copyright provisions as defined by the Copyright Act 1968.
  2. The Maps shall be used in a manner consistent with the Personal Information Protection Act 2004.
  3. The Maps are to be used personally or internally within your organisation to support the execution of your usual business activities.
  4. You may modify the Map and/or combine the Map with your data, however this will not:
    1. derogate from the ownership of the Map; or
    2. operate as an assignment of the copyright in the Map; or
    3. negate the Conditions of Use applicable to the Map.
  5. The Maps, in part, in full or in any way or form, shall not:
    1. be presented on an internet site;
    2. be on-sold, traded, distribute or given away;
    3. used to prepare a product for commercial gain
    4. be used in any way not described or contemplated in this COU;

unless prior written approval is provided from the Manager, Client Services, Land Tasmania. This may be in the form of a separate Data Licence, entirely at DPIPWE’s discretion. The Manager Client Services Land Tasmania can be contacted via tasmap@dpipwe.tas.gov.au

  1. Any product or service derived from the Map whether for commercial or non-commercial gains, internally or externally of your organisation must be accompanied by the relevant acknowledgment statement(s). The statements must be in a form visible to the human eye.

  1. You must ensure your employees, agents and sub-contractors are aware of and comply with the COU of the Maps.
  2. The Maps have been acquired from various sources and therefore are recorded and stored at different levels of reliability. DPIPWE does not warrant the accuracy, completeness, currency or suitability of the Maps; therefore you release DPIPWE from all liability whether in contract or tort arising from any defects and errors in the Maps.
  3. The Maps have not been prepared to meet your individual requirements and it is therefore your responsibility to ensure that the Maps meet any such requirement.
  4. DPIPWE is under no obligation to provide training or assistance in the use of the Maps or associated hardware/software to utilise the Maps.
  5. Failure to accept or adhere to any of the COU terminates any granted permission of use of the Maps. Consequently all use of the Maps must cease and the Maps returned to DPIPWE. The Maps and any related material and all copies thereof shall be erased from your storage media. This requirement applies to all copies of the Maps in any form, partial or complete and whether or not modified or merged into other materials.
